Terms & Conditions

Including Text Messaging Terms, Electronic Communications Consent, and Arbitration Agreement

Protection Partners, Inc. (doing business as Protection Partners Agency)

Effective Date: October 1, 2026 | Last Updated: October 1, 2026

1. Agreement to These Terms

These Terms & Conditions ("Terms") are a legal agreement between you and Protection Partners, Inc., doing business as Protection Partners Agency ("Protection Partners," "we," "us," or "our"). They govern your use of our primary website at ProtectionPartners.Net, every promotional, campaign, and landing-page website we operate, and every other website, domain, and landing page owned or operated by Protection Partners, Inc. (the "Sites"), and our text-messaging, email, and telephone programs and related services (together, the "Services").

You agree to these Terms when you check a box or click a button indicating agreement, submit a form, give your mobile number to one of our agents for text messages, reply to confirm a text subscription, or otherwise use the Services. If you do not agree, do not use the Services. Our Privacy Statement is part of these Terms.

You must be at least 18 years old and able to form a binding contract to use the Services.

2. About Protection Partners

Protection Partners is an independent insurance agency licensed in Florida (Agency License No. 17298561) and in each other state where it holds an insurance agency or agent license. When our licensed agents discuss, solicit, or sell insurance, they act as insurance agents. We represent multiple insurance companies. Not every company or product is available in every state or for every risk. We are not an insurance company, and we are not affiliated with any government agency, Citizens Property Insurance Corporation, or any government insurance program.

3. Quotes Are Not Coverage

Quotes, estimates, comparisons, and policy-review results are based on the information available when they are prepared. They are subject to the insurer's underwriting, inspection, eligibility rules, and approval. No coverage is bound or in effect until the insurer accepts your application, you receive written confirmation of coverage from us or the insurer, and any required premium is paid. Coverage is governed solely by the terms, conditions, limits, and exclusions of the policy the insurer issues. Do not cancel existing coverage until your new coverage is confirmed in writing.

4. Your Information and Your Phone Number

You agree to provide information that is true, accurate, and complete, and to update it promptly. Misstatements or omissions in an insurance application may result in denial of coverage, denial of a claim, or cancellation or rescission of a policy, as permitted by law (for example, Fla. Stat. 627.409).

When you provide a telephone number, you confirm that you are the subscriber or the customary user of that number and are authorized to consent to calls and texts to it. If you change, cancel, or transfer your number, you agree to tell us promptly so that we do not text a new subscriber. You agree not to provide another person's number without that person's permission.

5. Savings Statements, Campaigns, and Promotions
  • Savings are not guaranteed. Any savings depend on your property, vehicles, drivers, claims history, coverage choices, deductibles, insurer eligibility, and underwriting. A policy review may show that your current coverage is the best choice for you.
  • Campaign totals. Any public savings total or counter (for example, a "savings mission") reports documented savings using the methodology published with that campaign. Individual results vary.
  • No purchase necessary. No purchase is required to request a policy review, attend an event, or take part in a promotion, unless the official rules clearly state otherwise as permitted by law.
  • Gifts and referral rewards. Promotional items, gift cards, and charitable contributions are offered only within the limits of Fla. Stat. 626.9541(1)(m) and other state laws. That currently means a total of no more than $100 per person per calendar year. Referral rewards are never conditioned on whether the person referred buys insurance. We may change or end any promotion at any time, as permitted by law.
  • Sweepstakes and contests. These are governed by separate official rules, and by Fla. Stat. 849.094 where it applies.
6. Educational Content

Articles, videos, calculators, and other content on the Sites are general information, not legal, tax, or financial advice, and not a recommendation for your specific situation. Talk to a licensed agent about your needs. Your policy documents control over any general description of coverage.

7. Text Messaging Terms
7.1 Program description

The Protection Partners Agency text-messaging program sends recurring text messages (SMS/MMS) from our agency texting numbers, including (772) 297-2272, and from our licensed agents using our agency texting platform. Messages may include:

  • Service messages: appointment and policy-review scheduling, confirmations and reminders, quote follow-ups, document and signature requests, renewal and payment reminders, policy-change updates, and claims assistance; and
  • Marketing and promotional messages: offers, policy-review invitations, savings campaigns, product information, events, and referral programs.
7.2 Consent

By checking the text-message consent box, submitting a form that contains our text consent disclosure, replying YES (or another keyword we designate), or giving your mobile number to an agent and then confirming by text, you agree to receive recurring automated marketing and service text messages from Protection Partners Agency and its agents at the number you provided. Messages may be sent using an automated system. Consent is not a condition of any purchase. You can request a quote or buy insurance without agreeing to texts by calling (772) 297-2272.

Your consent is your electronic signature under the federal E-SIGN Act and Fla. Stat. 668.50. It serves as your prior express written consent under the TCPA and the Florida Telephone Solicitation Act.

7.3 Frequency and cost

Message frequency varies. Message and data rates may apply. Check your wireless plan for details. We do not charge for text messages.

7.4 How to opt out

Reply STOP to any message to stop receiving texts. We also accept STOP ALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, OPT OUT, and any other reasonable way you tell us you no longer want texts, including telling an agent, calling (772) 297-2272, or emailing Info@ProtectionPartners.Net. We may send one final message confirming your opt-out. We honor opt-out requests promptly, and in all cases within the time required by law (currently no more than 10 business days). You can opt back in at any time by replying START or UNSTOP.

Unless you tell us otherwise, a STOP request stops all text messages from our program. To stop only marketing messages and keep receiving appointment and policy service texts, reply STOP PROMO. Our confirmation message may ask you to clarify which messages you want to stop. For example, replying SERVICE keeps only appointment and policy service texts.

7.5 Help

Reply HELP for help, text (772) 297-2272, call (888) 801-8814, or email Info@ProtectionPartners.Net.

7.6 Delivery times and limits

We send marketing messages only between 8:00 a.m. and 8:00 p.m. in your local time zone, based on your address or area code. We will not send more than three (3) marketing messages to you on the same subject in any 24-hour period. Service messages you request (for example, a reply to your question) may be sent when needed.

7.7 Carriers and supported devices

Supported on major U.S. wireless carriers. Wireless carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by factors outside our control.

7.8 Privacy

Your mobile information and text opt-in data are handled as described in our Privacy Statement at ProtectionPartners.Net/privacy. We do not share mobile information or text opt-in data with third parties or affiliates for marketing or promotional purposes.

7.9 Sensitive information

Do not send Social Security numbers, full financial account numbers, or health information by text. Our agents will provide a secure method.

8. Calls, Voicemail, and Call Recording

By giving us your phone number and requesting a quote, review, or service, you agree that Protection Partners and its agents may call you at that number about your request. If you have given the consent described in Section 7.2, this includes marketing calls, and calls or voicemails may use automated technology or prerecorded messages where the law permits. Calls with Protection Partners may be monitored and recorded for quality, training, and record-keeping purposes. By continuing a call with us, you consent to recording. You may ask at any time to be placed on our internal do-not-call list.

9. Email

We may email you about your requests and policies. With your consent, or as permitted by law, we may also send marketing emails. Every marketing email includes an unsubscribe link, and we honor unsubscribe requests within 10 business days.

10. Consent to Electronic Records and Signatures

You agree that we may provide notices, disclosures, applications, policy documents (where permitted by the insurer and state law), and other records to you electronically. You also agree that your electronic signatures and click-through acceptances are legally binding under the federal E-SIGN Act (15 U.S.C. 7001 et seq.) and the Florida Uniform Electronic Transaction Act (Fla. Stat. 668.50). You need a device with internet access, a current web browser, a PDF reader, and a valid email address. You may request paper copies at no charge, or withdraw your consent to electronic delivery, by contacting us. Withdrawal applies only going forward.

11. Acceptable Use

You agree not to: submit false information or another person's information without authorization; interfere with or disrupt the Sites; use bots or automated tools to access or copy the Sites; upload malicious code; attempt unauthorized access; or use the Services for any unlawful purpose.

12. Intellectual Property

The Sites and their content, including text, graphics, logos, campaign names, videos, and software, are owned by or licensed to Protection Partners and are protected by intellectual-property laws. We give you a limited, revocable, non-exclusive, non-transferable license to use the Sites for personal, non-commercial purposes. Insurer names and logos belong to their owners.

13. Reviews, Testimonials, and Submissions

If you send us a review, testimonial, story, or other content, you give us a non-exclusive, royalty-free license to use it in connection with our Services. We will obtain your separate written permission before publishing your name, likeness, or savings results. We do not pay for reviews or condition any benefit on positive reviews. Testimonials reflect individual experiences and are not a guarantee of results.

14. Third-Party Sites and Services

The Sites may link to insurer portals, payment processors, scheduling tools, and other third-party services. We are not responsible for their content, policies, or practices. Your use of them is governed by their own terms.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITES AND THEIR CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED OR ERROR-FREE. NOTHING IN THIS SECTION LIMITS ANY DUTY WE OWE YOU AS A LICENSED INSURANCE AGENCY UNDER APPLICABLE INSURANCE LAW.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROTECTION PARTNERS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITES. FOR CLAIMS ARISING FROM YOUR USE OF THE SITES THEMSELVES, OUR TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR STATUTORY RIGHTS THAT CANNOT BE WAIVED, AND IT DOES NOT APPLY TO OUR PROFESSIONAL SERVICES AS YOUR INSURANCE AGENT, WHICH ARE GOVERNED BY APPLICABLE LAW.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Protection Partners from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your submission of a telephone number or information that you were not authorized to provide.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by the Federal Arbitration Act where it applies. For any claim not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Brevard County, Florida, except where the law of your state of residence gives you a non-waivable right to bring the claim elsewhere.

19. Arbitration Agreement and Class-Action Waiver
19.1 Informal resolution first

Before starting arbitration or a small-claims case, the party with a dispute must send a written notice describing the claim and the relief requested, to Info@ProtectionPartners.Net and 7630 N. Wickham Road, Suite 103, Melbourne, Florida 32940 (if to us) or to your contact information on file (if to you). Both parties will try in good faith to resolve the dispute within 60 days. Any time limit to file a claim is paused during this period.

19.2 What is covered

Except as provided in Section 19.4, you and Protection Partners agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Sites, or the Services will be resolved by binding individual arbitration. This includes claims about calls, text messages, emails, consent, and privacy, including claims under the Telephone Consumer Protection Act, the Florida Telephone Solicitation Act, and any similar state law. Questions about the scope, validity, or enforceability of this arbitration agreement are for the arbitrator, except as stated in Section 19.6.

19.3 Rules and costs

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time, available at adr.org. The arbitration will take place in the county where you live or in Brevard County, Florida, at your choice, or by video or telephone. For claims of $10,000 or less, you may choose to have the arbitration decided on written submissions only. We will pay all AAA filing, administration, and arbitrator fees for claims you bring, except that you will pay the portion of the filing fee equal to the court filing fee you would have paid in your local court. The arbitrator may award any individual relief a court could award and must follow the law. Each party pays its own attorneys' fees unless the arbitrator awards them under applicable law.

19.4 Exceptions

Either party may bring an individual claim in small-claims court if it qualifies. Either party may seek an injunction in court to stop infringement of intellectual-property rights. Nothing in this Section prevents you from filing a complaint with the Florida Department of Financial Services, the FCC, the FTC, or any other government agency. This arbitration agreement does not apply to claims under your insurance policy against an insurance company, which are governed by that policy.

19.5 Class-action and jury-trial waiver

YOU AND PROTECTION PARTNERS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.

19.6 Severability of the waiver

If a court finally decides that the class-action waiver in Section 19.5 is unenforceable as to a particular claim or request for relief, then that claim or relief (and only that claim or relief) will be severed and decided in court under Section 18, after all individual arbitrable claims are resolved. The rest of this Section 19 will remain in effect. A court, not an arbitrator, decides disputes about Section 19.5.

19.7 Mass filings

If 25 or more similar arbitration demands are filed against us by or with the help of the same law firm or organization, the AAA's Mass Arbitration Supplementary Rules will apply. The demands may be administered in batches, to the extent those rules and applicable law allow.

19.8 Your right to opt out

You may opt out of this arbitration agreement by sending written notice, including your name, address, phone number, and a clear statement that you opt out of arbitration, to Info@ProtectionPartners.Net or 7630 N. Wickham Road, Suite 103, Melbourne, Florida 32940 within 30 days after you first agree to these Terms. Opting out will not affect any other part of these Terms or your relationship with us.

19.9 Survival and changes

This Section 19 survives the end of your relationship with us. If we make a material change to this Section, the change will not apply to a dispute that you gave us notice of before the change.

20. Changes to These Terms

We may update these Terms by posting a revised version on the Sites with a new "Last Updated" date. Changes take effect when posted, except as stated in Section 19.9. If a change materially affects your text-messaging consent, we will obtain any new consent required by law. Your continued use of the Services after a change means you accept the updated Terms.

21. General Terms

These Terms and our Privacy Statement are the entire agreement between you and us about the Sites. They do not replace any insurance policy, application, or signed agreement you have with us or an insurer. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms. We may assign them to a successor. Headings are for convenience only. We are not responsible for delays caused by events beyond our reasonable control. Nothing in these Terms waives any right that applicable law says cannot be waived.
